Federal Railroad Administration (FRA), Department of Transportation (DOT).

ACTION:

Notice; Extension of comment period.

SUMMARY:

This document extends the period for public comment regarding the Association of American Railroads' (AAR) petition for relief from certain regulations concerning track inspections.

DATES:

FRA must receive comments on the petition by July 9, 2025. FRA will consider comments received after that date to the extent practicable.

SUPPLEMENTARY INFORMATION:

On May 9, 2025, FRA published notice? 1 that AAR, on behalf of its members, petitioned FRA for a waiver of compliance from 49 CFR 213.233(b) and (c), Visual track inspections, which specifies the method and frequency in which railroads must conduct visual track inspections. FRA assigned the petition Docket Number FRA-2025-0059.

On May 13, 2025, the Brotherhood of Maintenance of Way Employes Division, 2 and on May 14, 2025, the Transportation Trades Department, AFL-CIO, 3 requested that FRA extend the comment period on this petition. Through this notice, FRA is extending the comment period for an additional 30 days (until July 9, 2025).

FRA does not anticipate scheduling a public hearing in connection with these proceedings since the facts do not appear to warrant a hearing. If any interested party desires an opportunity for oral comment and a public hearing, they should notify FRA, in writing, before the end of the comment period and specify the basis for their request.

Communications received by July 9, 2025, will be considered by FRA before final action is taken. Comments received after that date will be considered if practicable.
