SUMMARY:

The Food and Drug Administration (FDA or Agency) is announcing the availability of a final guidance entitled "Orthopedic Non-Spinal Bone Plates, Screws, and Washers-Premarket Notification (510(k)) Submissions." This guidance document provides recommendations for information to include in 510(k) submissions for non-resorbable bone plate, screw, and washer devices. The scope of this guidance includes devices that are indicated for orthopedic bone fixation but does not include devices indicated for spinal, mandibular, maxillofacial, cranial, and orbital fracture fixation.

SUPPLEMENTARY INFORMATION:

I. Background

Non-spinal, non-resorbable bone plates, screws, and washers are implants intended for bone fixation. These are class II medical devices for which the safety and effectiveness are well-established. This guidance provides recommendations for the content and organization of premarket notification (510(k)) submissions including the information FDA recommends industry include in a 510(k) submission for these device types ( e.g., non-clinical testing, sterility, reprocessing, biocompatibility). This guidance is intended to facilitate consistency in information provided in submissions by addressing common deficiencies related to device description and performance testing and by identifying applicable cross-cutting guidances and consensus standards.

A notice of availability of the draft guidance appeared in the Federal Register of March 29, 2023 (88 FR 18549). FDA considered comments received and revised the guidance as appropriate in response to the comments, including clarification regarding recommended language for indications for use statements as well as additional considerations for predicate device comparisons when leveraging information from previously cleared devices.

This guidance is being issued consistent with FDA's good guidance practices regulation (21 CFR 10.115). The guidance represents the current thinking of FDA on "Non-Spinal Bone Plates, Screws, and Washers-Premarket Notification (510(k)) Submissions." It does not establish any rights for any person and is not binding on FDA or the public. You can use an alternative approach if it satisfies the requirements of the applicable statutes and regulations.
