Golden Triangle Storage, Inc; Request for Extension of Time
Take notice that on October 31, 2024, Golden Triangle Storage, Inc. (GTS) requested that the Commission grant an extension of time, until December 31, 2027, to complete the development of Storage Caverns 1 and 2 to their certificated storage capacities for the GTS Project in Jefferson and Orange Counties, Texas as authorized in the Order Authorizing Certificates issued on December 31, 2007. 1 On January 11, 2022, the Commission granted GTS an extension of time until December 31, 2024, to complete construction of the GTS Project, 2 the currently effective deadline for constructing and placing the GTS Project into service at certificated levels.

GTS explains that as of June 16, 2012, GTS placed all certificated facilities into service except the completion of Caverns 1 and 2 to their maximum certificated capacities. GTS further explains that, prior to this request, it requested and received three extensions of time, primarily to accommodate the lengthy cavern rewatering process required to enlarge the caverns to their full capacity and to deal with salt creep which slowly reduces cavern capacity. GTS states that it will not be able to complete the expansion of Caverns 1 and 2 by December 31, 2024, and therefore requests an extension of time until December 31, 2027.

As a matter of practice, the Commission itself generally acts on requests for extensions of time to complete construction for NGA facilities when such requests are contested before order issuance. For those extension requests that are contested, 3 the Commission will aim to issue an order acting on the request within 45 days. 4 The Commission will address all arguments relating to whether the applicant has demonstrated there is good cause to grant the extension. 5 The Commission will not consider arguments that re-litigate the issuance of the certificate order, including whether the Commission properly found the project to be in the public convenience and necessity and whether the Commission's environmental analysis for the certificate complied with the National Environmental Policy Act (NEPA). 6 At the time a pipeline requests an extension of time, orders on certificates of public convenience and necessity are final and the Commission will not re-litigate their issuance. 7 The Director of the Office of Energy Projects, or his or her designee, will act on all of those extension requests that are uncontested.
