Abstract: The Impact Aid Program, authorized by Title VIII of the Elementary and Secondary Education Act, as amended, provides financial assistance to Local Educational Agencies (LEA) whose enrollment or revenues are adversely affected by Federal activities. The ESEA, as amended, authorized a Discretionary Construction Grant program under Section 8007(b). The Impact Aid Discretionary Construction Program provides grants to eligible Impact Aid school districts for emergency repairs and modernization of school facilitates. The eligible Impact Aid school districts have a limited ability to raise revenues for capital improvements because they have large areas of Federal land within their boundaries. As a result, these districts find it difficult to respond when their school facilities are in need of emergency repairs or modernization; the Impact Aid Discretionary Construction Program assists these LEAs.
