The Commission will consider and act upon the following in open session: Secretary of Labor v. Brody Mining, LLC, Docket Nos. WEVA 2009-1000, et al. (Issues include whether the Administrative Law Judge erred by vacating certain "significant and substantial" designations and "unwarrantable failure to comply" designations.)
