The Commission will consider and act upon the following in open session: Secretary of Labor v. Black Beauty Coal Co., Docket No. LAKE 2008-477. (Issues include whether the judge erred in concluding that adequate berms had not been provided and that the violations were "significant and substantial" and due to unwarrantable failures to comply.)
