Environmental Impact Statements and Regulations; Availability of EPA Comments

Availability of EPA comments preparedpursuant to the Environmental ReviewProcess (ERP), under section 309 of theClean Air Act and Section 102(2)(c) ofthe National Environmental Policy Actas amended. Requests for copies of EPAcomments can be directed to the Office ofFederal Activities at 202-564-7146 or http://www.epa.gov/compliance/nepa/.

An explanation of the ratings assigned todraft environmental impact statements(EISs) was published in FR datedJuly 17, 2009 (74 FR 34754).

Notice

In accordance with Section 309(a) ofthe Clean Air Act, EPA is required tomake its comments on EISs issued by otherFederal agencies public. Historically, EPAhas met this mandate by publishing weeklynotices of availability of EPA comments,which includes a brief summary of EPA's commentletters, in the Federal Register . SinceFebruary 2008, EPA has been including its commentletters on EISs on its Web site at: http://www.epa.gov/compliance/nepa/eisdata.html.

Including the entire EIS comment letters on theWeb site satisfies the Section 309(a) requirementto make EPA's comments on EISs available to thepublic. Accordingly, after March 31, 2010, EPAwill discontinue the publication of this noticeof availability of EPA comments in the Federal Register .

Draft EISs

EIS No. 20090368, ERP No. D-NSA-E11071-TN, Y-12National Security Complex Project, to Support theStockpile Stewardship Program and to Meet theMission Assigned to Y-12, Oak Ridge, TN.

Summary: EPA expressed environmental concerns aboutstorage, transportation and disposal of hazardouswaste and radioactive wastes. EPA requestedadditional information about NPDES monitoring.Also, long-term onsite storage and disposition ofwastes will need to be addressed as the projectprogresses.Rating EC2.

EIS No. 20090378, ERP No. D-COE-F09806-MN, NorthMet Project, Proposes to Construct andOperate an Open Pit Mine and Processing Facility,Located in Hoyt Lakes-Babbitt Area of St. LouisCounty, MN.

Summary: The project as proposed will have satisfactoryimpacts to surface water and groundwater fromacid mine drainage and mobilization of metals andsulfates. The project will also have significantwetland impacts that are not adequatelymitigated. In addition, the EIS does notadequately evaluate the fate and transport ofpollutants between groundwater, surface water andwetlands, nor does it discuss financial assurancefor closure and post-closure care.Rating EU3.

EIS No. 20090386, ERP No. D-BLM-K09811-CA, Ivanpah Solar Electric Generating System(07-AFC-5) Project, Proposal to Construct a 400-mwMegawatt Concentrated Solar Power Tower,Thermal-Electric Power Plant, San BernardinoCounty, CA.

Summary: EPA expressed environmental concerns aboutimpacts to biological and aquatic resources, airquality and sensitive species. EPA alsorequested additional information to fullydescribe the project's purpose and need, broadenthe range of alternatives, and further evaluatecumulative impacts from reasonably foreseeablefuture actions.Rating EC2.

EIS No. 20090394, ERP No. D-USN-K11126-GU, Guamand Commonwealth of the Northern Mariana Islands(CNMI) Military Relocation, Proposed RelocatingMarines from Okinawa, Visiting Aircraft CarrierBerthing, and Army Air and Missile Defense TaskForce, Implementation, GU.

Summary: EPA identified adverse environmental impactsto Guam's drinking water and wastewaterinfrastructure from construction workers andinduced population growth, and to sensitive coralhabitat. The DEIS does not adequately assess theimpacts and infrastructure needs of theconstruction workers and induced growth, and doesnot include an adequate assessment of the impactsto the coral habitat or an adequate mitigationplan for those impacts.Rating EU3.

EIS No. 20090397, ERP No. D-USA-G39052-00, PROGRAMMATIC-Louisiana Coastal Area (LCA)Beneficial Use of Dredged Material (BUDMAT)Program Study, To Establish the Structure andManagement Architecture of the BUDMAT Program,Implementation, MS, TX and LA.

Summary: EPA does not object to the proposed action.Rating LO.

EIS No. 20100008, ERP No. D-GSA-F65079-00, International Falls Land Port of EntryImprovements Study, Proposes to Replace theExisting Land Port of Entry, Minnesota along theU.S. and Canada Border.

Summary: EPA expressed environmental concerns about waterquality impacts from stormwater runoff andhazardous materials spills. EPA recommended thatappropriate runoff and spills management beincorporated into the project.Rating EC2.

EIS No. 20090437, ERP No. F-COE-E39077-NC, Western Wake Regional Wastewater ManagementFacilities, Proposed Construction of RegionalWastewater Pumping, Conveyance, Treatment, andDischarge Facilities to Serve the Towns of Apex,Cary, Holly Springs and Morrisville, ResearchTriangle Park, Wake County, NC.

Summary: EPA expressed concerns about environmentaljustice impacts and maintaining EPA-approvedState of North Carolina Water Quality Standardsfor Surface Waters.

EIS No. 20100006, ERP No. F-AFS-L65570-00, RogueRiver-Siskiyou National Forest, Motorized VehicleUse, To Enact the Travel Management Rule,Implementation, Douglas, Klamath, Jackson, Curry,Coos and Josephine Counties, OR and Del Norte andSiskiyou Counties, CA.

Summary: EPA expressed environmental concerns aboutimpacts to human health that could result fromexposure to naturally occurring asbestos (NOA).EPA recommended that a plan be developed andimplemented to address risk from NOA.

EIS No. 20100007, ERP No. F-NOA-B91005-00, Amendment 3 to the Northeast Skate ComplexFishery Management Plan, Implementation of NewManagement Measures to Rebuild Overfished SkateStocks, End Overfishing of Skate Fisheries, Gulfof Maine (GOM), Georges Bank (GB), South NewEngland and Mid-Atlantic Regions.

Summary: EPA does not object to the proposed project.

EIS No. 20100011, ERP No. F-AFS-K65376-CA, EddyGulch Late-Successional Reserve Fuels/HabitatProtection Project, To Protect Late-SuccessionalHabitat used by the Northern Spotted Owl andOther Late-Successional-Dependent Species, SalmonRiver and Scott River Ranger District, KlamathNational Forest, Siskiyou County, CA.

Summary: EPA's previous issues have been resolved;therefore, EPA does not object to the proposedaction.
